New Ontario labour laws to remove barriers for newcomers seeking jobs

Starting January 1, 2026, several new requirements for publicly advertised job postings will take effect under changes to Ontario’s Employment Standards Act (ESA). Among the most significant is a ban on requiring Canadian work experience in job postings.

The amendment prohibits employers from including a requirement for “Canadian experience” as a criterion in publicly advertised job postings. This change is designed to remove a longstanding barrier that many newcomers face when trying to enter the Canadian labour market.

Key changes include:

  • Employers cannot require “Canadian experience” in job postings
  • Job postings must include the expected salary range
  • Employers must disclose if artificial intelligence is used in the hiring process
  • Enhanced transparency requirements for job advertisements
